Roy v. County of Los Angeles is a class action lawsuit against the Los Angeles Sheriff’s Department (LASD) for jailing people on immigration detainers (aka “ICE holds”). In 2018, the federal court ruled that the LASD violated the United States constitution by jailing people solely on the basis of ICE holds. 

The parties have now reached a settlement that provides for money compensation to class members. The Settlement must still be approved by the Judge. 

If you are a Class Member, you may be entitled to MONEY, up to $1,000 per day that you were held on the ICE hold before resolution of your criminal charges. In addition, you may be entitled to MONEY, up to $1,000 per day, for each day you were held on the ICE hold after you were entitled to release on your criminal charges. (Specifically, if you had pending removal proceedings or a removal order at the time the detainer was issued, you are not entitled to money under the settlement.)

To receive money, you must submit a Claim no later than October 10, 2021. You can submit a Claim by mailing back a copy of the Claim Form, submitting it online at Submit Claim, or emailing it to [email protected].

Who is Included?

You may be a class member if you were affected by one of the following three practices: 

• Detention on ICE Holds:  You may be a class member if you had an ICE hold and you were detained at a Los Angeles County jail after your criminal charges fully resolved (for example, you were detained on an ICE hold after a judge ordered you released or after you served your full sentence). The class does not include people who had prior removal (deportation) orders. It also does not include people who were already in removal (deportation) proceedings when the ICE hold was issued. (Class period: 10/19/2010 – 6/14/2014)

• Booking Arrestees Who Should Have Been Released Due to Low Bail:  You may be a class member if you had an ICE hold and you were booked into jail on charges with a total bail amount of less than $25,000. There are some exceptions, which we will review on an individual basis. (Class period: 10/19/2010 – 6/14/2014)

• Refusing to Accept Bail: You may be a class member if the Sheriff’s Department denied you the right to post bail because you had an ICE hold. (Class period: 10/19/2010 – 10/18/2012)

                                              YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT

Submit a Claim Form By  October 10, 2021: This is the only way to receive a cash benefit. You should have received a Claim Form in the mail. You may also complete a Claim Form by visiting the 'Submit Claim' section of the website.

Exclude Yourself By  October 10, 2021: Exclude yourself by October 10, 2021 and get no benefit from the proposed Settlement.  This is the only choice that allows you to participate in another lawsuit against Defendant about the claims at issue in this case for the products and claims covered by the Class Period.

Object by  October 10, 2021: You can write to the Court by October 10, 2021 about why you don’t like the Settlement.

Go to the Hearing: You can ask to speak in Court about the fairness of the proposed Settlement.  You must do so in writing by  October 10, 2021.

Do Nothing: Get no payment.  Give up your rights to sue Defendant regarding any of the claims at issue in this case.
